This Privacy Policy explains how Human Cloud, Inc. and its affiliates ("Human Cloud," "we," "us," or "our") collect, use, disclose, and safeguard personal information in connection with our websites, applications, APIs, marketplace, and related services (collectively, the "Service"), and describes the rights and choices available to you.
By using the Service, you agree to the practices described in this Policy. This Policy is incorporated into and subject to our Terms of Service.
1. Scope
This Policy applies to personal information we process about visitors, account holders, Buyers, Solutions, their representatives, and other individuals who interact with the Service. It does not apply to third-party websites, products, or services that we do not control, or to information that a Buyer or Solution collects, uses, or shares under its own policies in the course of an engagement.
2. Information We Collect
We collect the following categories of information:
- Account and profile information — name, email, phone, password, company, role, business details, solution descriptions, credentials, certifications, portfolios, and other information you provide.
- Marketplace activity — shortlists, RFPs, responses, quotes, pricing, messages, documents and contracts you exchange, engagements, reviews, kudos, and related content.
- Transaction and billing information — plan, orders, and payment details (processed by our payment providers; we do not store full card numbers).
- Usage and device information — pages viewed, features used, clicks, referring URLs, IP address, browser and device type, operating system, and approximate location, collected automatically.
- Cookies and similar technologies — as described in the Cookies section below.
- Communications — messages, support requests, survey responses, and correspondence with us.
- Information from third parties — data from integrations, partners, data-enrichment providers, social or authentication providers, and publicly available sources, which we may combine with information we already hold.
3. How We Use Information
We use personal information to:
- provide, operate, maintain, secure, and improve the Service;
- create and manage accounts and authenticate users;
- facilitate discovery, matching, shortlisting, RFPs, responses, and engagements between Buyers and Solutions;
- calculate, generate, and refine the HC Score, rankings, recommendations, analytics, and other AI-powered features;
- process transactions, billing, and fees;
- communicate with you, including service, security, and transactional messages and, where permitted, marketing;
- personalize content and features;
- monitor, detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms;
- develop new products and features and conduct research and analytics; and
- comply with legal obligations and enforce our agreements.
4. How We Share Information
We may share personal information as follows:
- Between Buyers and Solutions — profile, RFP, response, message, document, and engagement information is shared with the counterparties you interact with, as necessary to operate the marketplace (subject to any anonymity settings you choose).
- Service providers — vendors who process data on our behalf (e.g., hosting, analytics, payments, communications, AI, customer support), under contractual confidentiality and security obligations.
- Legal and safety — when we believe disclosure is required by law, legal process, or governmental request, or is necessary to protect the rights, property, or safety of Human Cloud, our users, or others, or to enforce our terms.
- Business transfers — in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.
- With your consent or at your direction — including when you choose to make information public or share it through the Service.
We do not sell personal information in the traditional sense of exchanging it for money. Where applicable law defines "sale" or "sharing" more broadly, you may exercise the choices described below.
5. Cookies and Tracking
We and our partners use cookies, pixels, local storage, and similar technologies to operate the Service, remember your preferences, authenticate you, measure performance, and understand how the Service is used. You can control cookies through your browser settings and, where offered, through our cookie controls in the Service. Disabling some cookies may affect functionality.
6. Data Retention
We retain personal information for as long as necessary to provide the Service, fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the context. When information is no longer needed, we delete or de-identify it.

We implement technical, administrative, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, and alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

Depending on where you live, you may have rights to access, correct, update, port, restrict, or delete your personal information, to object to or opt out of certain processing (including certain targeted advertising and profiling), and to withdraw consent where processing is based on consent. We will respond consistent with applicable law and may need to verify your identity. You will not be discriminated against for exercising your rights.
9. International Data Transfers
We are based in the United States and may process and store information in the United States and other countries that may have data-protection laws different from those in your jurisdiction. Where required, we implement appropriate safeguards for cross-border transfers. By using the Service, you understand that your information may be transferred to and processed in these countries.
10. Children's Privacy
The Service is not directed to children under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.
11. Third-Party Links and Integrations
The Service may contain links to, or integrate with, third-party websites and services that operate under their own privacy policies. We are not responsible for their practices, and we encourage you to review their policies.
